Welcome to PixEarn ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our platform, website, features, tools, and services, available through pixearn.com. By using or accessing any part of the PixEarn platform, you agree to be bound by these Terms. If you do not agree, you may not use our platform.

PixEarn operates in accordance with Indian law and is committed to maintaining compliance with all relevant legal obligations. All users must also comply with their local laws when using the platform.

2. Platform Overview

PixEarn is an online platform that enables users to explore, upload, and interact with a wide variety of digital imagery, including AI-generated and human-created wallpapers. Our focus is on visual content that can be appreciated, shared, and even monetized by artists and creators.

Registration Requirements:

Registration is mandatory for engaging with advanced platform features like liking, commenting, saving images to personal collections, or following other users. However, basic features such as browsing, viewing, downloading, and sharing images are accessible to all users without registration.

User Access Levels:

We allow both free and premium users to access content. Premium features will be rolled out in the near future to provide more control, customization, and monetization tools to our creators.

Ownership and Responsibility:

All content hosted on PixEarn is uploaded by independent users. PixEarn does not claim ownership over any submitted content. We operate as a platform provider, not as a publisher or reseller.

Reporting Infringements:

If you believe someone has uploaded your copyrighted content without permission, you may submit a claim. To process your takedown request, please provide:

• A direct link to the original content proving your ownership
• Metadata or timestamp that verifies date of creation
• Any relevant licenses, registrations, or legal claims

Personal Use Clause:

Free images are strictly limited to personal use. Commercial usage, redistribution, or resale is prohibited without the original creator’s permission.

3. User Roles

PixEarn distinguishes users into the following categories:

• General Users: Any internet user, aged 8 and above, can explore the site. While children between 8 to 13 years may use the platform, we recommend parental oversight due to content that may include intense imagery (e.g., action or thriller).
• Creators: Users who begin contributing their own wallpapers, illustrations, or images are designated as creators. Creators gain access to tools for publishing, analytics, and potential monetization.
• Admins: Only verified PixEarn staff have administrative access. Admins may moderate content, manage disputes, and enforce policy.

Important: Monetization eligibility is unlocked only when a creator meets certain community criteria like achieving a minimum number of followers and monthly views. Check Monetization Policy

4. Monetization Policy

PixEarn offers a revenue-sharing model where creators are rewarded for their engagement and impact. This includes earnings based on views, likes, and eventual premium purchases.

5. User Content Policy

Content moderation is essential for platform quality. We implement a combination of automated and manual moderation systems to ensure the platform remains safe and compliant.

Content Restrictions:

• NSFW content is currently prohibited. Future inclusion may be allowed under strict conditions.
• We do not and will not allow content related to politics, violence, war, real-world conflict, or content intended to harm emotional or cultural sensitivities.

Copyrighted Content:

• Uploading copyrighted material for commercial or monetized distribution is strictly forbidden.
• Usage of such content for personal-only purposes may be tolerated but discouraged.
• Repeat violators (5 or more infractions) will be permanently banned.

Marketing and Promotional Use:

PixEarn does not permit uploading copyrighted or non-original images for the purpose of external marketing or advertising.

6. Acceptable Use

Users must adhere to principles of fair use and ethical interaction while using PixEarn.

Prohibited Activities:

• Use of bots, scrapers, scripts, or automation tools to manipulate data, views, or content
• Attempting to exploit vulnerabilities or gain unauthorized access

Permitted Sharing:

Users may freely share images using platform-provided tools. All sharing links point back to the original image page to maintain credit and traffic integrity.

7. Account Handling

We encourage responsible user behavior and offer account management options to maintain transparency and trust.

Violation Handling:

• First violation: Temporary ban (10–15 days)
• Repeated violations: Permanent account suspension

Account Deletion Process:

• When a deletion request is received, the user’s profile and content are deactivated for 14 days.
• If the account is not recovered in that period, it will be permanently deleted.
• We will securely store a hashed version of the email to prevent abuse and assist in future account verification.
• No content, analytics, or personal data will be recoverable after deletion.

8. Legal Responsibility

• Users are solely responsible for the content they upload and its compliance with all applicable laws.
• PixEarn is not liable for any damages, misuse, or losses resulting from platform usage or content visibility.
• Our platform is a tool for creative sharing and not a legally regulated image marketplace.

9. Privacy & Data Collection

Our practices are outlined in full in our Privacy Policy. Summary of data policies:

Visitor Data:

We hash and temporarily store IPs to detect spam and abuse without retaining identifiable information.

User Data:

• Collected info: email, full name, hashed IP, device metadata
• Monetized users must also provide ID and address proof (deleted after 30 days), payment info, and verification documents

Payment Methods:

• India: Bank Transfer, UPI, PhonePe, Google Pay, Paytm, PayPal
• International: PayPal only

Data Usage:

We store transaction records, payment logs, and basic analytics to ensure operational continuity

10. Modifications & Termination

We may update these Terms at any time. Continued use of PixEarn implies acceptance of the latest Terms.

While we may evolve these Terms, core commitments around privacy, legal compliance, and safety will always be retained.

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws of India. All legal actions must be resolved through the Indian legal system.

12. Third-Party Services

PixEarn uses external services like Supabase, Vercel, and analytics providers. While we choose reliable vendors, we are not responsible for any breaches or losses caused by these external platforms.
